Conditions of Redemption of the WUNSCHGUTSCHEIN GmbH

The Wunschgutschein GmbH, Rosental 6, 80331 München, telephone number: 0032-800 261 91, e-mail address: info@wunschgutschein.be, registered at the District Court Arnsberg, VAT identification number: DE329263839, represented by its managing directors Verena Argauer, Dr. Andreas Betzer, Florian Pauthner & Valentin Schütt, ("Provider", "we", "us") is the issuer of various voucher products, including the EVERYWISH voucher.

The following Conditions of Redemption ("GTC") shall apply in their most recent version to the redemption of our voucher products, such as EVERYWISH vouchers ("WGS Vouchers") for the purchase of vouchers from our partners ("Partner Vouchers") by the bearer of the voucher ("Customer", "you"). Terms and conditions that conflict with or deviate from these GTC shall not apply unless the Provider expressly agrees to their application in writing.

1. GENERAL PROVISIONS

1.1 You acquire the Partner Voucher ordered by you on the basis of these GTC by redeeming your WGS Voucher. In this context, you enter into a contract with the Provider.

1.2 Some partners may not offer voucher categories with the same face value as that of the WGS Voucher. In this case, several Partner Vouchers may be acquired. An additional payment may be required in order to fully utilise any remaining balance of the WGS Voucher. The issuers and debtors with regard to the Partner Vouchers ordered by you in the course of redeeming the WGS Voucher are the respective partners, who will provide their services on the basis of their own contracts and subject to their own terms and conditions.

1.3 We are obliged to send you the Partner Voucher(s) ordered.

1.4 We are not under any obligation to cooperate with a particular partner on a permanent basis. If a former partner ceases to be part of the cooperation program, any WGS Vouchers purchased can no longer be used to obtain Partner Vouchers from the respective partner. This shall also apply in the event that a partner was advertised as a partner at the time the WGS Voucher was purchased.

2. REDEMPTION PROCESS FOR WUNSCHGUTSCHEIN VOUCHERS

2.1 In order to redeem your EVERYWISH voucher, please visit the web address indicated on the EVERYWISH voucher and follow the instructions provided there. To obtain a Partner Voucher, you will need the voucher code (“My Code“) printed on the back of your EVERYWISH voucher or displayed on your electronic EVERYWISH voucher.

2.2 Once you have selected a partner, a window will appear allowing you to click on a button entitled "Request voucher". If you click on this button, you will be asked to enter your name and e-mail address. To complete the process, you must accept the Conditions of Redemption and click on "Purchase". By doing so, you are submitting an offer to purchase the Partner Voucher by redeeming your EVERYWISH voucher.

2.3 Your offer is accepted upon confirmation of your order. Depending on which Partner Vouchers you have ordered, you will receive them by post or by e-mail and can then redeem them through our partners. The EVERYWISH voucher can only be redeemed once. Once the process has been completed, it is no longer possible to exchange Partner Vouchers for those of other partners. There is no obligation to store Partner Vouchers after this time. In the event that the Provider is required to store the vouchers for processing or other mandatory reasons, such storage periods shall not exceed 48 hours for security reasons.

2.4 The EVERYWISH voucher must be redeemed in your own name and for your own account. Redemption in the name of a third party is not permitted.

2.5 The Provider reserves the right to suspend, freeze, or delay the redemption of the EVERYWISH voucher for an additional review if such measures are necessary to prevent offences of money laundering and fraud. In the event that such a restriction of use is triggered by our system, the Customer may achieve the use of the EVERYWISH voucher through a verification/authentication check.

2.6 The use of refunds, kick-back payments, discounts, or other monetary benefits granted in connection with the purchase of the EVERYWISH voucher and intended to directly or indirectly obtain a discount on purchases in the partner shops is not permitted.

2.7 The purchase of EVERYWISH vouchers for the purpose of resale is only permitted if prior written consent has been obtained from the Provider. This also includes the use of EVERYWISH vouchers for the purchase of goods or services that are acquired for the purpose of resale by redeeming the balance on one or more EVERYWISH vouchers.

3. DELIVERY OF THE PARTNER VOUCHER

3.1 We will deliver your Partner Voucher to you electronically within one business day following your order, and usually within a few minutes. The delivery time for shipments by post is 7 – 14 business days.

3.2 We will deliver the Partner Voucher of our partner by e-mail or by post using the Deutsche Post, DHL or DPD. Unfortunately, it is not possible to collect the Partner Voucher yourself.

4. LIABILITY, WARRANTY

4.1 The warranty of the Provider (Wunschgutschein GmbH) for the Partner Voucher acquired is subject to the applicable statutory provisions. We further guarantee that the Partner Voucher obtained by redeeming the WGS Voucher confers a valid and enforceable claim against the respective partner for the purchase of the goods or services offered by that partner (in the case of the WUNSCHGUTSCHEIN voucher also including third-party providers integrated on the web site of the respective partner) corresponding to the respective face value of the Partner Voucher.

4.2 The liability of the Provider (Wunschgutschein GmbH) is subject to the applicable statutory provisions.

4.3 In the event of any complaints or questions in connection with the procurement of your Partner Voucher as part of the redemption of your WGS Voucher (in particular questions regarding delivery or liability for any defects), our service team can be contacted during regular business hours by telephone 0032-800 261 91 or at info@everywish.be by email.

5. DISPUTE RESOLUTION PROCEDURE

Through Regulation (EU) No 524/2013, the European Commission has established a platform for the out-of-court settlement of disputes, which can be accessed, for example, at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (information according to Article XVI.4 §1, Belgian Economic Law Code).
